1. SWEEPSTAKES ENTRY PERIOD: The Neauvia North America 2022 Win $1000 Worth of Skincare Giveaway (the “Sweepstakes”) begins at 12:00AM ET June 21, 2021 and ends at 11:59PM ET August 21, 2022 (the “Sweepstakes Period”). Sponsor’s computer is the time-keeping device for the Sweepstakes.
2. ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Void outside the fifty (50) United States, District of Columbia, and wherever else prohibited by law. Customers, Employees, and Contractors of Allergan, Inc. (the “Sponsor”), Licensed Healthcare Providers, and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter. People enrolled in Medicare, Medicaid, or other federal or state healthcare programs are not eligible to enter. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
3. SPONSOR AND ADMINISTRATOR: Neauvia North America, 8480 Honeycutt Road Raleigh, North Carolina 27615, United States.
4. HOW TO ENTER: To participate, you must have an Instagram account. Instagram accounts are free, but subject to Instagram LLC’s terms of service: https://help.instagram.com/581066165581870. The Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram. During the Sweepstakes Period, find Sponsor’s post advertising this Sweepstakes (the “Sweepstakes Post”) on the @neauviaus Instagram account. To qualify to enter the Sweepstakes, you must follow the @neauviaus account on Instagram. Once you qualify, you will receive one (1) Entry into the Sweepstakes. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules.
5. PRIZE DRAWINGS: Sponsor will serve as the administrator for the Sweepstakes and whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Sponsor will randomly select the potential Sweepstakes winner from all eligible Entries received during the Sweepstakes Period, on or around August 22, 2022. One (1) Entrant will be selected as the winners (“Winners”). Winners will be notified by @neauviaus via Direct Message on Instagram. To claim the prize (described in paragraph 6 below), Winner must, within five (5) days after Sponsor sends said Direct Message notifying Winner that he/she is the Winner, provide his/her name, mailing address, email address, and date of birth to Sponsor to confirm eligibility and for prize fulfillment purposes. If the potential Winners of the Prize cannot be contacted, fail to provide any requested information within the required time period, or the Prize is returned as undeliverable, the potential Winners are disqualified and forfeits the Prize. Receiving the Prize is contingent upon compliance with these Official Rules.
6. PRIZES: THREE PRIZES: The Winners will get one (1) package of Neauvia skin care products valued at one thousand dollars ($1000). Winners will be contacted via direct message to obtain Winners’ email, phone number, and address. Approximate Retail Value (“ARV”) of the Prize: $1000. ARV of Sweepstakes: $1000. Each Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer the Prize or redeem the Prize for cash or cash equivalent. Sponsor reserves the right to substitute a Prize for one of equal or greater value if the designated Prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with Prize receipt and/or use. Odds of winning the Prize depend on the number of eligible Entries received during the Sweepstakes Period. Limit: One (1) Prize per Entrant. Prize will be fulfilled approximately three (3) to four (4) weeks after Winner confirmation is complete. Prize cannot be redeemed for cash.
7. RELEASE: By participating in this Sweepstakes, Entrants agree to release and hold harmless Sponsor, Instagram, LLC, Facebook, Inc., and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and Prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, in whole or in part, directly or indirectly arising out of participation in the Sweepstakes or receipt or use or misuse of the Prize.
8. PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes each Winner’s consent to Sponsor’s and its agents’ use of Winner’s name (including, without limitation, Winner’s Instagram handle), prize information, Entry, photograph (including, without limitation, Winner’s Instagram profile photo) and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. If you choose to share your winnings on your own social media channel, we ask you to disclose that your post is connected to our giveaway. 9. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for the Prize offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for:
    1. any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes;
    2. technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
    3. unauthorized human intervention in any part of the entry process or the Sweepstakes;
    4. technical or human error which may occur in the administration of the Sweepstakes or the processing of Entries;
    5. late, lost, undeliverable, damaged, or stolen mail; or
    6. any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of the Prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, not received, or otherwise destroyed or corrupted, Entrant’s sole remedy is another Entry in the Sweepstakes, if it is possible. No more than the stated number of Prizes will be awarded.
11. GOVERNING LAW AND ARBITRATION: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of Entrants, Sponsor, or the Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. The parties hereto each agree to finally settle all disputes only through arbitration; provided, however, the Released Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in Wake County, North Carolina and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. Sponsor and entrant agree that, except as set forth above, any claim, suit, action, or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. If an in-person hearing is required, then it will take place in Wake County, North Carolina. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate does not apply and the dispute must be brought in a court of competent jurisdiction in Wake County, North Carolina. Sponsor agrees to pay the administrative and arbitrator’s fees to conduct the arbitration (but specifically excluding any travel or other costs of the entrant to attend the arbitration hearing).
12. PRIVACY; USE OF DATA: Entrants and Winners hereby agree to Sponsor’s collection and use of their personal information according to Sponsor’s privacy policies, which are available at https://neauvia-us.com/privacy-policy/.
